Terms of service

First.- General Provisions.-

Without prejudice to the application and enforcement of the General Terms of Use mentioned above, these General Terms of Contracting, along with any Specific Conditions that may be established, will govern the service and contractual relationships between Bath and Home Design, S.L., hereinafter Bath and Home Design, and each user who, through the portal, contracts the products and/or services offered, whose characteristics and prices are duly identified in their respective access points.

These General Terms of Contracting are supported by the provisions of Law 34/2002 on Information Society Services and Electronic Commerce; Law 7/1998 on General Terms of Contracting; Royal Decree 1906/1999 regulating Telephone or Electronic Contracting with General Conditions under Article 5.3 of Law 7/1998; Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws; Law 3/2014 of March 27 amending the revised text of the aforementioned General Law for the Defense of Consumers and Users and other complementary laws; Law 7/1997 on the Regulation of Retail Trade; Royal Decree-Law 14/1999 regulating Electronic Signatures, and any other applicable legal standards.

Browsing the portal, using and/or acquiring any of the products and/or services from the portal implies the user's unconditional acceptance of all the present General Terms of Contracting, the General Terms of Use of the portal, and any Specific Conditions that may be established.

Bath and Home Design informs that the procedures for acquiring goods and/or products and/or contracting the services offered on this portal are those described in these General Terms of Contracting, as well as any other specific ones indicated on-screen during navigation. The user declares their knowledge and acceptance of these procedures as necessary for accessing the products and/or services offered on the portal.

The products and/or services offered on the portal, along with their characteristics and prices, will appear on-screen. In addition to the price and before confirming the order, the total shipping costs to the address designated by the user will appear on-screen. Shipping costs to the mainland are included in the product price. The prices shown on-screen are in euros and include VAT and/or any other applicable taxes, and they will always be the current prices, except for typographical errors.

Offers will be properly indicated on-screen. Bath and Home Design reserves the right to decide at any time which products are included on the portal and offered to users through it. Thus, Bath and Home Design may at any time add new products to those included on the portal, which will be governed by the General Terms of Contracting in force at that time unless stated otherwise. Likewise, Bath and Home Design reserves the right to stop providing access, at any time and without prior notice, to any of the products offered on the portal. The products displayed on the portal have indicative measurements, colors, and characteristics and provide an approximation of reality. Occasionally and eventually, these may not fully match the actual products. Therefore, users are advised to verify the exact appearance and technical conditions of the product before purchasing it through the portal.

Second.- Procedure for Acquiring Products and/or Services on the Portal.-

To purchase the products and/or services on the portal, the user must follow the on-screen instructions and confirm the purchase by complying with these instructions, which also implies the reading and irrevocable acceptance of all these General Terms of Contracting and the prior Use of the portal, as well as any applicable Specific Conditions.

The user will browse through the various sections and select the product or products they wish to purchase by clicking the "add to cart" button. The selected products will accumulate in what is called the "cart." At any time and at the end of the purchase process, once all desired products and/or services have been selected, the user must click the "Place Order" button. They will then be redirected to a series of pages where they will be informed that the acquisition of the order is subject to prior payment and will be shown the subsequent steps of the purchase process.

The products will be available for sale while stocks last. The product and service prices and transport fees shown on-screen are in euros and include VAT and/or any other applicable taxes and will always be the current prices unless there is a typographical error.

If the requested product or service becomes unavailable after placing the order, the user will be informed by phone or email to proceed with its replacement or cancellation for a similar product or service as agreed with the user.

Shopping cart: a purchase summary will appear, listing all items added to the cart, with a brief description of the product’s configuration or characteristics, quantity, and price, with the option to add or remove items and the possibility to apply a discount code before proceeding to checkout.

Checkout page: at this stage, the user will be asked to provide the following information: a) full name, b) shipping address, c) contact phone number, and billing information (which may not need to be entered again if it matches the shipping information).

Once this information has been filled in, the user must choose their preferred payment method and click the "Place Order" button.

Payment for the purchased goods or services and shipping costs shown on-screen can be made by credit card, debit card, Visa, MasterCard, or PayPal. The user must select one of the available methods and fill out the corresponding form based on their selection.

All data provided for these purposes are encrypted to ensure maximum security and are stored on a secure server certified according to the SSL protocol.

Once the payment method has been selected and the necessary data filled in, the user must click the "Confirm Payment" button. The purchase information (order summary, shipping details, etc.) will be displayed and simultaneously sent by email. When the order is ready for shipment, the user will receive another email with this information and the order reference number for tracking.

Bath and Home Design reserves the right to request from any user who has made a purchase to justify the payment and/or identify themselves by providing a document through electronic means (fax, email, or similar) proving their identity as the buyer or buyer’s representative and their delivery address.

All information provided during the contracting process will be stored by Bath and Home Design so that the user can, upon request by email, obtain information on transactions made at any time.

Users have the right to receive a free invoice for their purchases by requesting it via email at soporte@bhdhome.com after receiving the order.

Third.- Discount Codes.-

The user can use discount codes for their orders on the portal. We may send promotional emails with discount codes. We are not responsible for errors in the recipient’s email address for the code.

Discount codes are transferable and can be given to another person. In cases of fraud, attempted deception, or suspected illegal activities related to the purchase or use of discount codes, we reserve the right to disallow their use. We are not responsible for the loss, theft, or illegibility of gift or promotional vouchers.

Specific Conditions for Redeeming Promotional Vouchers

Occasionally, we issue discount codes that can be used on the portal. These codes will be sent via email, the web platform, or social media and can only be redeemed on the web platform. Discount coupons are valid only for the specified period, for one-time use, and cannot be combined with other promotional vouchers, offers, and discounts. Some brands or products may be excluded, which will be detailed.

If the order amount is lower than the promotional voucher’s value, the difference will not be refunded. Discount codes do not generate interest and have no cash value. If the order amount exceeds the discount voucher’s value, the user must pay the difference with another payment method. Discount codes cannot be combined with other offers.

Fourth.- Availability of Orders.-

Bath and Home Design may only provide the transport service for products, articles or materials purchased through this web platform. The transport service covers the entire Spanish territory, with the exception of the Canary Islands, Ceuta and Melilla.

Bath and Home Design, through this web platform, will display the most up-to-date information possible regarding the availability and stock of the requested articles. However, it is possible that the item or product, whose availability has been confirmed, may be sold out during the purchase process itself (including and also taking into account the time that the user may incur when making and completing the corresponding payment, such as in cases of payment by transfer or financing) or that delivery times may be delayed for different reasons. Delivery times will always be estimated:

  • During high season dates (between the months of April to August)
  • Special discounts
  • Natural or environmental causes
  • Strikes beyond the control of Bath and Home Design
  • For reasons of force majeure beyond the control of Bath and Home Design. such as delays by logistics agencies
  • Delays in deliveries from suppliers due to high demand, and/or products with special characteristics (size, lacquers, mechanisms or others that are delayed for production reasons)

 


In the event of these situations occurring, Bath and Home Design will inform the user by sending an email or by phone, offering the following alternatives:

(i) delivery of the same product or item within a longer period than initially agreed;
(ii) replacement of the product or item with another of similar characteristics, functionality, quality and price; whenever possible;
(iii) refund of the price charged whenever possible;

Bath and Home Design will deliver the goods purchased by the user to the user's address/house/building (first door for small shipments, or at the vehicle/street level, for shipments of large packages), indicated for this purpose by the user as delivery details - products will not be delivered to PO boxes or public places - within the period indicated in the order (in accordance with applicable regulations) and as soon as Bath and Home Design has confirmation of payment for the aforementioned order. The carrier will move the merchandise to the agreed point as long as it is possible with the carrier's material and mechanical means and the architectural characteristics of the house, address or building allow it (ceiling height, elevator, stairwell, etc.).

If the user needs or believes that he/she needs additional help for the delivery of the products due to circumstances beyond the control of the carrier, such as those mentioned above, we ask that the user inform us so that, if possible at Bath and Home Design's discretion, we can estimate the additional charge according to the requirements that the user needs to make the delivery effectively. Otherwise, the products, articles or materials can only be deposited, for delivery purposes, at the vehicle/street level.

In line with the above, the user is informed that the delivery of the products, due to their weight or volume, can only be made at the vehicle/street level and not at the first door of the address, house or building indicated for this purpose. The carrier, in no case, is obliged to leave the products at the door level, but it is obliged to leave them at the street level. Bath and Home Design is not responsible for the lack or delay in the delivery of the merchandise when the user has indicated or specified an incorrect, false or non-existent delivery address.

No cardboard or old furniture will be removed and the delivered products will not be unpacked.

Without prejudice to the provisions regarding the legal guarantee of our consumer products, we ask and thank users that, if the requested product arrives in poor condition due to transport and this is detected (check if the box or packaging is damaged or not), they must indicate it on the delivery note and/or electronic or mobile device of the carrier itself and call our Customer Service within twenty-four (24) hours of receipt at +34 942 324 160 or at the email address soporte@bhdhome.com from 07:00am – 15:00pm Monday to Friday (both included), except on national and/or local holidays.

In the event of not carrying out this procedure (signing the receipt of the shipment as "unreviewed" or "non-compliant" and not notifying the Bath and Home Design sales department within 24 hours of the incident, Bath and Home Design is subject to the policy of the transport company and therefore has no responsibility to assume responsibility for it.

Additionally, the user is informed, under his/her own responsibility, that in no case and under no circumstances should the user pay or make any delivery of money to the carrier itself. In the event that this occurs or that you are encouraged or invited to deliver any sum of money to the carrier, we ask that you contact Bath and Home Design so that it can investigate the matter and, if necessary, take appropriate measures in this regard.

Delivery times may be delayed on days of special discounts.

Without prejudice and completely independent of the right of withdrawal and the legal guarantee in force at any time in terms of consumption, Bath and Home Design is not responsible for any damages that may occur in the order or any of its parts at the time of collection or delivery as a result of improper, incorrect or careless handling or use of said order by the customer or, where applicable, by the person authorised to collect it.

Fifth.- Shipping. Returns and Cancellations.

Shipping
Shipments are made through an external transport company. The customer will receive an email with the tracking code for their order so that they can make the appropriate arrangements regarding its delivery.

Delivery times are given as an indication, and delays that may occur for internal or external reasons will not give rise to any claim.

Orders to the Peninsula are usually delivered within 2-5 working days.

Orders to the Balearic Islands may take between 3-7 working days.

Shipping costs
Orders over €50: Free shipping.

Orders under €50: A fixed cost of €15 will be applied for shipping.

I want to cancel my order
The user will have a maximum period of twenty-four hours (working day), except if their order is already in the process of preparation, to cancel their order. This twenty-four hour period will be calculated from the date on which the purchase was made (if it is made on a Saturday, the calculation of the twenty-four (24) hours will be carried over to the following business Monday). Order cancellations must be processed through the Bath and Home Design Customer Service telephone number +34 942 324 160 or the email address soporte@bhdhome.com during business hours Monday to Friday, both included, from 7:00 a.m. to 3:00 p.m., except national or local holidays. Cancellations may only be made by the person who contracted the orders, and no person may do so on behalf of the contracting party.

I want to return my order
Returns of custom-made products are not accepted. Bath and Home Design, in the cases set out below, will collect the product and rectify it, in order to send the product back to the customer.

The product does not correspond to the order. The product arrives with manufacturing errors that affect the quality or aesthetics of the product.

Refund
We offer refunds and exchanges within 14 days of receiving your order.

Once we receive and inspect your return, we will notify you if the refund has been approved. If applicable:

  • The refund will automatically be processed to your original payment method within 10 business days.
  • Please note that banks or credit card issuers may take a few additional days to reflect the refund in your account.

Return Policy and Right of Withdrawal

Once you have received your order, you have 14 days to withdraw from the purchase (except for personalized products) from the date of delivery, provided that the product has not been used and has its original packaging, as well as all its original accessories or promotional gifts, if any.

You must contact us to process the return, by sending an email to soporte@bhdhome.com

We remind you that when you exercise your right of withdrawal, we will refund the money paid for the product(s) purchased, deducting the transport costs derived from the delivery of the product, if any.

Once the product has been received in our warehouses and after checking its condition, we will proceed to refund its amount through the payment method used in the purchase, within a maximum period of 15 days after notification of withdrawal.

Your right to withdraw from the contract will apply exclusively to those products that are returned in the same condition in which they were received, except for personalized products. No refund will be made if the product has been used beyond the mere opening of the packaging, for products that are not in the same condition in which they were delivered or that have suffered any damage, so you must be careful with the product(s) while they are in your possession. Please return the item including all its original packaging, labels and other parts and accessories that may accompany it.

Personalized Products

Personalized or made-to-measure products are governed by Law 3/2014, of March 27 (article 103) that modifies the LOCM art. 45 the Consumer's Right of Withdrawal and Return. If you purchase a clearly personalized item (choice of color of materials, size, fabric, etc.), once it has been manufactured (and even if it has not been delivered to you) you will not be able to withdraw from the purchase contract or claim a refund of its cost.

Sixth.- Payment Methods.-

1. CREDIT AND DEBIT CARDS

You can make the payment through our secure payment platform “Shopify Payments”, which is specially enabled for payment with debit or credit cards.

Your card details are managed directly by the bank, guaranteeing the proper management of your confidential data.

Bath and Home Design is in no case aware of your credit card details and information, nor does it store these details.

Nowadays it is completely safe to make purchases with a card over the internet, thanks to the international security protocols that banks comply with.
The purchase will only be made if you enter the code that is instantly sent to your mobile phone linked to the card.

Bath and Home Design guarantees maximum security in payments made with VISA, VISA ELECTRON, MASTERCARD, MAESTRO, AMEX and UNIONPAY cards.

2. PAYPAL

Register at PayPal. Open your free PayPal account and link your credit cards.
Pay with PayPal. Look for the PayPal button at checkout and easily purchase by entering your email address and password. ...

Seventh.- Guarantees.-

Guarantee for lack of conformity.
The guarantee period for lack of conformity is two years from the date of delivery of the product. Bath and Home Design will be liable to the BUYER for any lack of conformity that becomes apparent within the guarantee period in accordance with the terms of the Revised Text of the General Law for the Protection of Consumers and Users and other complementary Laws. There will be no liability for any lack of conformity that the buyer knew about or could not have ignored at the time of entering into the contract. In the event of lack of conformity, the BUYER will have the right, at his/her discretion, to the repair or replacement of the product. The reduction in price and the termination of the contract will proceed, at the BUYER's discretion, when the latter cannot demand repair or replacement and in cases where they have not been carried out within a reasonable time or without major inconvenience to the consumer. Termination will not proceed when the lack of conformity is of little importance. For this purpose, you must notify Bath and Home Design of the lack of conformity as soon as possible, and in any case, and at most, within the legal period of TWO MONTHS, from when you became aware of it. Unless proven otherwise, it will be understood that the consumer's communication has taken place within the established period.

Commercial Guarantee and After-Sales Service.
The product offered has the manufacturer's commercial guarantee under the legally established terms, but in no case includes deficiencies caused by negligence, knocks, improper use or manipulation, connection to the electrical network other than that indicated in the user manuals, incorrect installation not carried out by the authorized technical service when applicable, or materials subject to wear and tear due to normal use. The manufacturer offers an after-sales service through its technical services, the conditions of which can be consulted on the website.

Duration
The duration of the guarantee (is guaranteed for a period of 5 years. It is essential to inform Bath and Home Design of any defect, such as a knock, scratch, hole or cut detected in the product within the following 10 working days from the date of receipt of the product. The guarantee does not take into account post-sale labour.

Warranty Application Method
The guarantee covers any problem found in the use of the product for any foreseen event and not excluded by the commercial guarantee, provided that said problem arises within the validity of the guarantee. To be covered by the guarantee, the product must have been installed in accordance with the regulations, and the commercial guarantee does not include in any case the following cases:

  • Natural wear and tear of the product due to normal deterioration due to use over the years.
  • Breakdowns or damage caused by incorrect use, misuse and/or treatment of the product on the product or rubbing against any surface.
  • Breakdowns or malfunctions due to obvious manipulation by the customer or by personnel other than Bath and Home Design
  • Damage to automation systems due to the use of pressurized water, chemical products or inadequate cleaning habits.
  • Damage caused as a result of natural disasters, acts of God, terrorist attacks, malicious damage, fires or force majeure caused by atmospheric agents (winds, storms, hail, snow, torrential rain, etc.) and any other event that may occur or happen beyond the responsibility and/or fault of Bath and Home Design, its employees and products, all of which are listed by way of example and not exhaustive.
  • Natural deterioration or abrasion of the product. This effect does not constitute a fault of the product and is therefore not covered by the warranty.
  • Post-installation regulations.
  • The warranty is limited to the repair or replacement of parts that are defective or that cause the device to malfunction with other identical parts. The warranty does not in any case cover the costs of transporting, disassembling and installing the product, nor any direct or indirect damages.

 


Customer Obligations

At the time of delivery, you must check the goods: check that they are exactly what you ordered (measurements, finish, etc.) and verify that the goods have not been damaged in transit. Returns will not be accepted for damage caused by transport not specified on the delivery note; if you detect any damage to the packaging or product, you must indicate this on the delivery note and sign it. It is important that, if possible, you photograph the package in order to document it in the event that, upon unpacking at home, the material is damaged, in which case you must notify Bath and Home Design within the following 48 hours of receiving the order by emailing: soporte@bhdhome.com. The transport of the goods from the delivery point (which is done at street level, i.e., the door of a building or building) to the home, as well as the installation of the product, is the responsibility of the customer and the guarantee does not cover damage caused in these instances.

Bath and Home Design's Responsibility

This company declines all responsibility for possible damage to people, animals or things that may be caused due to misuse of the product or poor installation. Liability for damage caused by force majeure is also declined.

Eighth.- Incidents.-

What to do if the product arrives defective?

If the product is covered or within the warranty period, you must send an email to soporte@bhdhome.com, our technicians will analyze the case as soon as possible. If it is proven that the defect is the responsibility of Bath and Home Design, the corresponding department will contact you to proceed with the repair or replacement of the product.

In this case, the customer will need to check the operation and condition of the product before anything else, uninstall it (if necessary) and package it, to return it together with all the corresponding accessories and complements, if possible within the original packaging (since it is specially designed for the protection of the product during transport), so that it can be collected and returned to the factory for inspection. Once the package has been prepared, you must notify the Customer Service department by email at soporte@bhdhome.com, so that we can process the incident and order the collection of the defective product.

It could also be a transport incident, in which case Bath and Home Design will not be recognized as responsible, and will claim the damages caused to the corresponding transport agency, this not being a reason for evasion of commitment with respect to the client and the contracted product or service.
Bath and Home Design reserves the right to not accept an incident and it should be noted that it is entitled to claim financial compensation for the collection and repair if the product has been damaged, modified or has been sent outside its original packaging or in unsuitable packaging.

How do we resolve an incident?

Once our technicians have received the product, the incident will be diagnosed and it will be decided whether the repair or replacement of the product is covered by the manufacturer's warranty.

If the product is covered by the manufacturer's warranty, the customer will not be charged for the collection, repair or reshipment of the goods. If, on the other hand, it is determined that the product defect was caused by reasons beyond Bath and Home Design's control or that it is not covered by the commercial warranty, the customer must pay the amount of the collection, repair and reshipment of the product.

In the event that the incident is not covered by the manufacturer's warranty, but you would like it to be repaired anyway, you can consult our repair conditions below. All customers have the right to a prior written estimate for the repairs or services requested.

Our Official Technical Assistance Service adjusts the rates for its repairs to offer you the highest quality at the best price.

Ninth.- Complaint Form.-

Bath and Home Design, in compliance with current regulations, informs that it has complaint forms available to the user.

Tenth.- Legislation and Jurisdiction.-

The relations between Bath and Home Design and the Buyers are governed by Spanish legislation and jurisdiction. Bath and Home Design and the Buyer, expressly waiving any other jurisdiction that may apply to them, submit to the Courts and Tribunals of the Buyer's domicile for the resolution of conflicts related to these matters. In the event that the Buyer is domiciled outside of Spain, Bath and Home Design and the Buyer submit, expressly waiving any other jurisdiction, to the courts and tribunals of Cantabria.
